Minnesota law does not define the components or methods of a custody evaluation nor does it designate specific qualifications that a custody evaluator must possess. Therefore, custody evaluators come from an array of different professional backgrounds. It is your responsibility, working with your attorney, to select a custody evaluator who meets the unique requirements of your particular situation and to discuss the custody evaluator's fees and procedures prior to retaining him/her in your case.

Mediation
Minnesota law governs mediation through the Minnesota Rules of Practice-District Courts, Rule 114 and Minn. Stat §518.619. The definition of mediation according to the Rules of Practice-District Courts, Rule 114.02(a)(7) is:
Mediation. A forum in which a neutral third party facilitates communication between parties to promote settlement. A mediator may not impose his or her own judgment on the issues for that of the parties.
Mediators, in order to be court appointed, must complete 40 hours of certified mediation training as described in Rule 114, in addition to their specific professional skill set.

Parenting Consultants
Typically a professional acting as a parenting consultant to a family is doing so pursuant to a court order that defines the parenting consultant's duties and responsibilities. Parenting consultants work to resolve disputes between parents. This method is usually less expensive and less time consuming than asking the court to resolve the dispute. Most parenting consultants will require that the parents sign a contract prior to providing services regardless of whether or not a court order exists. Be sure to read the contract carefully and, if it conflicts with the court order, make certain to resolve the issues before starting work with the professional.

Parenting Coordination
This term is often used interchangeably with Parenting Consultant and is closely associated with the Association of Family and Conciliation Courts (AFCC) Guidelines for Parenting Coordination 2005. Please see the entire document at:

Parenting coordination is generally described as a child-focused process intended for high conflict parents with a history of entrenched disputes. There should be a court order appointing the parenting coordinator. The professional will ordinarily assess, educate, engage in case management and parent education, provide conflict management, and make decisions on matters that do not invade the exclusive purview of the court.

Parenting Plan Assistance
Minn. Stat. §518.1705 permits parents to devise a plan or, if you will, contract to co-parent their children in the future. Many professionals have sample forms you can use, although parents frequently find it helpful to work with a professional to construct the plan. Parenting Time Expediting
The parenting time expeditor, as defined by Minn. Stat. §518.1751 Subd. 1b, is an individual charged with resolving parenting time disputes by enforcing, interpreting, clarifying, and dealing with circumstances not specifically addressed by an existing parenting time order. A parenting time expeditor can be appointed at the request of either party, through stipulation, or by court order.

Parenting Time Supervision
The following individuals are willing to provide supervision of parenting time (visitation). Generally supervised parenting is by court order as a result of concerns for the well-being of the child or children. The court order will typically set forth the details of how a parent's time with his/her child shall be supervised, including whether or not the supervisor will provide parenting education and advice, whether or not written summaries of visits will be provided, and who will pay the supervisor's fees. Under most circumstances, the parenting supervisor can be called as a witness and his/her records subpoenaed.
